GENERAL AND DEFINITIONS

Only the present conditions of sale apply to the distance sale (exclusively practiced online) made by AGRIPP to its final customers (hereinafter "the Buyer") for the goods offered for sale by AGRIPP.

They apply to the exclusion of all other conditions, even those included on any order form that emanate from the Buyer.

AGRIPP reserves the right to modify at any time its general conditions.

Nevertheless, current contracts remain subject to the conditions applicable at the time the sale is concluded.

The general conditions are communicated to the Buyer at the time of the encoding of the data concerning him and / or the sending of forms by the Buyer to AGRIPP.

If necessary, with the confirmation of his order, the Buyer receives the general conditions of sale, in a format that he can store or print.

The agreement is concluded exclusively in French.

The subsequent exchange of information may also be in that language or in the English language, without prejudice to the legal determination of the language of the agreement.

The Purchaser will not be able to rely on his lack of knowledge of the chosen language in order to invoke the non-application of one or more conditions.

Where appropriate, the provisions will apply only to the sale to "consumers", that is to say to any natural person who acts for purposes which do not fall within the scope of his commercial, industrial activity, artisanal or liberal.

CONCLUSION OF THE DISTANCE SALE

To book or order merchandise online, the Buyer must add it to his cart.

He then places an order, if necessary after having created his account and filled in the personal data strictly necessary for the conclusion of the sale, including a mandatory e-mail address and a delivery address.

He chooses a method of payment.

To conclude the reservation or the order, the customer must click on the "payment" button and make the payment.

The catalog of goods and their description appearing on https://www.agripp.com, does not constitute an offer as such.

It is therefore not sufficient to reserve or order a product on the AGRIPP website for the formation of the sales contract.

The sales contract will only be definitively concluded upon receipt of the confirmation e-mail from AGRIPP.

For the security and certainty of the customer, AGRIPP reserves the right to ask for additional information and to refuse the execution of the order for lack of adequate response.

AGRIPP may refuse to execute any order made by a minor.

This is also applicable when a manifest error is introduced in the description of a commodity or in the indication of its price on the website, despite the great attention that AGRIPP gives to the accuracy of the information. .

In case of force majeure, AGRIPP reserves the right to suspend its obligations for the duration of the case of force majeure, or to terminate the contract definitively.

TRANSFER OF OWNERSHIP

The goods sold, delivered or installed remain the exclusive property of AGRIPP until full payment of our invoices.

Notwithstanding this retention of title, all the risks of loss and damage relating to the property concerned are transferred to the customer upon taking possession.

PRICE

Prices include VAT and all other taxes and contributions.

All offers are valid as long as they are listed on the website. Prices quoted can always vary.

When you place an order, the effective price for this purchase is the price in effect at the time of this order.

Standard delivery and shipping are free unless explicitly stated otherwise.

PAYMENT

For its online order, the Buyer can make his payment using only the means of payment offered (eg Visa, Mastercard, Bancontact, ...).

DELIVERY AND INSTALLATION

All goods are delivered to the address or pick-up point indicated by the Buyer. For the security of the Buyer, proof of his identity may be requested upon delivery. Buyer signs for receipt.

Home delivery is normally done by a public or private mail service (only on the ground floor).

In the absence of the Buyer, the courier deposits in his mailbox a notice, mentioning the place of withdrawal ("point poste" or other) in which the Buyer may come to remove his goods on presentation of his card. identity. It has the deadline indicated in the notice.

DELIVERY DELAY

For goods in stock at the time of order one or more delivery dates are offered to the Buyer, who may make a choice. For delivery at pick-up point, the period within which the order will be available is indicated.

For goods that are out of stock at the time of the order, a maximum delivery time of 60 working days is in force, unless explicitly agreed otherwise.

As soon as the goods are in stock, AGRIPP contacts the Buyer to set a delivery date in case of home delivery.

AGRIPP is not liable for damages resulting from late delivery or non-delivery by the designated carrier.

In such a case, the liability remains limited to the value of the goods, for which the customer provides proof of non-receipt.

Any claim for apparent damage to the packaging of the goods delivered must, to be taken into consideration, be mentioned on the delivery documents at the time of delivery by the courier.

Claims for damage or defects to the goods themselves must be made by email to philippe@agripp.com, always within 24 hours of delivery.

GUARANTEE CONDITIONS FOR CONSUMERS

For consumers, the legal warranty of two (2) years applies. For non-consumers, the warranty is one (1) year.

(A) This warranty only covers existing defects of conformity at the time of delivery of the goods. Are therefore excluded:

     - Any direct or indirect damage caused to the product after delivery (eg by oxidation, shock, fall, ...);

     - The replacement of elements or accessories whose regular renewal is necessary;

     - Damage resulting from fire, water damage, lightning, accident, natural disaster;

     - defects caused expressly or by negligence, improper treatment, poor maintenance or abnormal use or not in accordance with the manufacturer's instructions;

     - Damages resulting from commercial, professional or collective use.

(B) The lack of conformity must be reported within two months after its finding.

(C) Any request for intervention must be addressed to our after-sales service.

(D) In ​​case of intervention by a third party not designated by AGRIPP, the benefit of the guarantee is canceled.

(E) The general conditions of repair apply to all repairs.

These conditions and restrictions do not affect the legal provisions in this regard.

RIGHT TO RETRACT

This provision applies only to distance selling to consumers.

This provision therefore does not apply to any natural person in the context of his commercial, industrial, craft or professional activity, nor to legal persons.

The consumer purchaser may withdraw from the contract, without having to justify his decision, within 14 days from the date of delivery.

The consumer purchaser has the choice:

(A) It reports the goods, accompanied by the invoice or receipt, to the headquarters of AGRIPP, within 14 days from the date of delivery.

(B) Either he communicates in writing, within 14 days from the date of delivery, his decision to retract: either by e-mail to the following email address "philippe@agripp.com", or by post to the Address of AGRIPP SPRL, Henri Stacquet Street 22, B-1030 BRUSSELS, BELGIUM.

AGRIPP sends the Buyer a confirmation e-mail after receipt of your withdrawal decision and after receipt of the goods concerned.

The goods must be returned, as far as possible, in their original packaging, with all accessories supplied, and in their original condition.

The Buyer is responsible for the depreciation of the goods resulting from the manipulations other than those necessary to establish the nature, the characteristics and the good functioning of these goods. The Buyer is also bound to respect the goods and to handle them with care.

Within 14 days following the communication to AGRIPP of the Purchaser's decision to withdraw, all amounts paid will be refunded via the same payment method used by the Purchaser at the time of purchase (minus shipping and handling costs). the aforementioned depreciation, if any).

No cash refund can however be obtained from AGRIPP.

AGRIPP reserves the right to defer reimbursement until the goods are recovered, or until the consumer has provided proof of shipment of the goods.

PROOF

The parties accept the electronic means of proof (e-mail, backup, ...).
